These Terms of Service ("Terms") govern your access to and use of Chartwise and its related services ("Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Your account

You must provide accurate information when creating a Chartwise account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised.

Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. We reserve the right to change our pricing with reasonable notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

Service availability

We aim to keep Chartwise available and reliable but do not guarantee uninterrupted access. We may occasionally suspend the Service for maintenance, security updates, or other operational reasons. Where possible we will provide advance notice of planned downtime.

Intellectual property

The Service and all content, features, and functionality within it are owned by Chartwise and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

You grant Chartwise a limited license to host, store, and display the data and content you submit through the Service solely for the purpose of operating and improving it.

Limitation of liability

To the maximum extent permitted by law, Chartwise shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the three months preceding the claim.

Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users. You may terminate your account at any time through your account settings. Upon termination, your right to access the Service ends immediately.

Changes to these terms

We may update these Terms from time to time. If we make material changes we will notify you by email or through a notice on our website. Continued use of the Service after updated Terms take effect constitutes your acceptance of the changes.

Governing law

These Terms are governed by the laws of the jurisdiction in which Chartwise operates, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.
